Tran<\/em>, an appeal from the US Court of Appeals for Veterans Claims (an Article I court).<\/p>\n\n\n\n<p>The Federal Circuit took this appeal en banc <em>sua sponte<\/em> (not as my autocorrect would like to spell it: &#8220;<em>sea sponge<\/em>&#8220;)<\/p>\n\n\n\n<p>The questions presented are:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>A. Does the rebuttable presumption of the availability of equitable tolling articulated in&nbsp;<a href=\"https:\/\/scholar.google.com\/scholar_case?case=11927141805979408147&amp;q=Arellano&amp;hl=en&amp;as_sdt=4,131\"><em>Irwin v. Department of Veterans Affairs,<\/em>&nbsp;498 U.S. 89, 111 S.Ct. 453, 112 L.Ed.2d 435 (1990),<\/a>&nbsp;apply to 38 U.S.C. \u00a7 5110(b)(1), and if so, is it necessary for the court to overrule&nbsp;<a href=\"https:\/\/scholar.google.com\/scholar_case?case=10516311931992118651&amp;q=Arellano&amp;hl=en&amp;as_sdt=4,131\"><em>Andrews v. Principi,<\/em>&nbsp;351 F.3d 1134 (Fed. Cir. 2003)<\/a>?<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>B. Assuming&nbsp;<em>Irwin<\/em>&#8216;s rebuttable presumption applies to \u00a7 5110(b)(1), has that presumption been rebutted?<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>C. Assuming this court holds that&nbsp;<em>Irwin<\/em>&#8216;s rebuttable presumption applies to \u00a7 5110(b)(1), would such a holding extend to any additional provisions of \u00a7 5110, including but not limited to \u00a7 5110(a)(1)?<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>D.
