NEAPCO HOLDINGS<\/em>, 966 F.3d 1347 (Fed. Cir. 2020), Judge Dyk wrote a concurring opinion in the denial of rehearing en banc. He notes that with respect to step one in the <em>Alice<\/em> inquiry there can be a factual issue.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cThe step-one \u201cdirected to\u201d inquiry in this case, as in&nbsp;O\u2019Reilly, is what the claim says.
