The case is <a href=\"https:\/\/scholar.google.com\/scholar_case?case=5588970922452974049&amp;q=jarkesy&amp;hl=en&amp;as_sdt=4,110,125\"><em>Jarkesy v. SEC<\/em>, 34 F.4th 446 (5th Cir. 2022)<\/a>. <\/p>\n\n\n\n<p>Some of the issues raised in the oral argument at the Fifth Circuit are somewhat related to those that were raised in the <em>Arthrex<\/em> and <em>Oil States<\/em> decisions.  The <em>Oil States<\/em> decision is also discussed in the <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/securities-and-exchange-commission-v-jarkesy\/\">briefing<\/a> to the Supreme Court, as well as in the dissenting opinion at the Fifth Circuit.<\/p>\n\n\n\n<p>You can listen to the Fifth Circuit oral argument here:<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"20-61007  Jarkesy v.
