Kappos<\/span>,\u00a0one can&#8217;t help but be reminded of the <span style=\"text-decoration: underline;\">Diamond v. Chakrabarty<\/span>, 447 U.S. 303 (1980)\u00a0case.\u00a0 In that case the\u00a0Supreme Court dealt with\u00a0the scope of\u00a0 section 101 and whether a living organism constituted patentable subject matter.\u00a0 Dr. Chakrabarty&#8217;s invention\u00a0dealt with an oil digesting bacteria that could digest about two-thirds of the hydrocarbons found in a typical oil spill.\u00a0 With its landmark decision, the Supreme Court declared Dr. Chakrabarty&#8217;s invention patentable.\u00a0 That bacteria would later be used to remediate the oil spill from the Exxon Valdez and presumably will be used on the oil spill in the Gulf, as well.<\/p>\n<p>Dr. Chakrabarty&#8217;s invention and the\u00a0<span style=\"text-decoration: underline;\">Diamond v. Chakarabarty<\/span> decision underscore\u00a0the benefits of an expansive\u00a0interpretation of 35 U.S.C. \u00a7101 &#8212;\u00a0an interpretation\u00a0that\u00a0<span style=\"text-decoration: underline;\">encourages<\/span> innovation and <span style=\"text-decoration: underline;\">promotes<\/span> the disclosure of new ideas.\u00a0<\/p>\n<p>You can listen to the oral argument in <span style=\"text-decoration: underline;\">Diamond v.
