U.S."},"content":{"rendered":"<p>On July 8th, 2010, the Federal Circuit sat <em>en banc<\/em> to consider the <span style=\"text-decoration: underline;\">Hyatt v. Kappos<\/span> case.\u00a0 On that same day, the court also sat <em>en banc<\/em> in a case appealed from the U.S. Court of Federal Claims captioned <span style=\"text-decoration: underline;\">Slattery v. U.S<\/span>.\u00a0 It was interesting to note that during the <span style=\"text-decoration: underline;\">Slattery v. U.S.<\/span>\u00a0oral argument, Judge Dyk made reference to a portion of the <span style=\"text-decoration: underline;\">Bilski<\/span>\u00a0decision.\u00a0 [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2010\/07\/2007-5063-slattery-excerpt.mp3\">Listen<\/a>].<\/p>\n<p>The other interesting fact about the oral arguments of <span style=\"text-decoration: underline;\">Hyatt v. Kappos<\/span> and <span style=\"text-decoration: underline;\">Slattery v. U.S.<\/span>\u00a0 is that while Chief Judge Rader presided over\u00a0both oral arguments he\u00a0did not ask a single question in either oral argument.\u00a0 He frequently asks questions in other cases.\u00a0 So, one might assume that his reticence had to do with his view of his\u00a0new role as Chief Judge.<\/p>\n<p>You can listen to the entire <span style=\"text-decoration: underline;\">Slattery v.
