{"id":2732,"date":"2010-08-09T10:16:50","date_gmt":"2010-08-09T16:16:50","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=2732"},"modified":"2010-08-09T10:16:50","modified_gmt":"2010-08-09T16:16:50","slug":"is-the-mention-of-a-reference-in-the-background-a-disclosure","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=2732","title":{"rendered":"Is the mention of a reference in the Background a &#8220;disclosure&#8221;?"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-family: Calibri; font-size: small;\">Have you ever run across a patent that discusses a prior art reference in the Background of the patent; but, in looking at the References Cited section of the patent as well as the file wrapper for the patent you see that the reference mentioned in the Background was neither IDS\u2019d<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>by the applicant nor cited by the examiner?<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Have you ever wondered whether that amounts to inequitable conduct?<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>I\u2019ve researched the issue a little in the past and never was able to locate a case that decided the issue.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>So, I was intrigued to hear the oral argument in <span style=\"text-decoration: underline;\">Ring Plus v. Cingular Wireless<\/span>, 2009-1537 (Fed. Cir. Aug. 6, 2010) which had similar facts.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-family: Calibri; font-size: small;\">The panel determined that there was insufficient evidence to prove intent to deceive the PTO.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>It noted that this was not a non-disclosure case because the references at issue were disclosed in the application itself (<em style=\"mso-bidi-font-style: normal;\">i.e.<\/em>, in the Background section).<span style=\"mso-spacerun: yes;\">\u00a0\u00a0 T<\/span>he district court\u2019s finding of unenforceability due to inequitable conduct was reversed.\u00a0 The opinion stated:<\/span><\/p>\n<div><span style=\"font-family: Calibri; font-size: small;\"><\/span><\/div>\n<p><span style=\"font-family: Calibri; font-size: small;\"><span style=\"font-size: small;\"><\/p>\n<blockquote>\n<p align=\"justify\">Cingular notes that the applicants prepared, but decided not to file, an IDS that listed both Strietzel and Sleevi. Again, this evidence relates to materiality, but not intent. While it may have been relevant if this was a non-disclosure case, it is not; Sleevi and Striezel were disclosed in the application itself.<\/p>\n<\/blockquote>\n<p>\u00a0<\/p>\n<p><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-family: Calibri; font-size: small;\">The exchanges between the judges and the attorneys during the oral argument were very interesting.<span style=\"mso-spacerun: yes;\">\u00a0\u00a0 <\/span>The defendant-appellee argued that MPEP Section 609 in force in 2004 required citation of the reference by the applicant.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>[<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2010\/08\/2009-1537-exerpt-1.mp3\">Listen<\/a>] and [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2010\/08\/2009-1537-excerpt-2.mp3\">Listen<\/a>].<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-family: Calibri; font-size: small;\">The plaintiff-appellant argued that the MPEP requires the examiner to read the application before conducting a search.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Since a search was conducted, the plaintiff-appellant argued that the examiner must have read the entire application and been aware of the references. . . .
