Chakrabarty"},"content":{"rendered":"<p>Following <span style=\"text-decoration: underline;\">Gottschalk v. Benson<\/span> in 1972\u00a0and <span style=\"text-decoration: underline;\">Parker v. Flook<\/span> in 1978, the U.S. Supreme Court again had the opportunity to consider 35 USC section 101 in <span style=\"text-decoration: underline;\">Diamond v. Chakrabarty<\/span> in 1980.\u00a0 The Court held that a patent claim for a\u00a0live, human-made microorganism is patentable subject matter as either a manufacture or composition of matter under 35 USC section 101.\u00a0<\/p>\n<p>The counsel for the\u00a0patent applicant\u00a0argued, in part, that because the USPTO had recognized microorganisms as a unique subclassification in its classification system and had issued at least 60 patents for microorganisms that the PTO had already recognized microorganisms as being patentable.\u00a0 You can hear part of that argument [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2009\/08\/Diamond v Chakrabarty excerpt.mp3\">here<\/a>].\u00a0<\/p>\n<p>Interestingly, the USPTO just recently\u00a0published a PowerPoint presentation on business methods.\u00a0 It is available [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2009\/08\/partnership_meeting_7-09.ppt\">here<\/a>].\u00a0 In this presentation, the USPTO recognizes that it issued 1600 business methods in 2008.\u00a0 Assuming the PTO issues roughly\u00a0157,800 patents every year, the 1600 patents accounted for only 1.0% of all patents issued by the USPTO.\u00a0<\/p>\n<p>You can listen to the entire oral argument in\u00a0<span style=\"text-decoration: underline;\">Diamond v.
