Google<\/span>, 2010-1117 (Fed. Cir. Jan. 11, 2011) was whether the district court was in error in awarding expert fees to Google.\u00a0 To award such fees is beyond 35 U.S.C. \u00a7285 alone\u00a0and requires invoking the inherent powers of the court.\u00a0 However, the standard to be applied by the court to invoke such inherent powers is whether &#8220;fraud has been practiced upon it, or that the very temple of justice has been defiled.&#8221;\u00a0\u00a0 So,\u00a0during the oral argument, Chief Judge Rader\u00a0inquired whether\u00a0the temple of justice had been defiled:\u00a0[<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2011\/01\/2010-1117-temple-of-justice.mp3\">Listen<\/a>].<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0\u00a0\u00a0\u00a0 One of the issues that came up in the oral argument of the recently decided case of iLOR v.
