{"id":3807,"date":"2011-03-10T23:43:11","date_gmt":"2011-03-11T05:43:11","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=3807"},"modified":"2011-03-10T23:50:09","modified_gmt":"2011-03-11T05:50:09","slug":"aspect-of-the-invention","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=3807","title":{"rendered":"&#8220;Aspect of the invention&#8221;"},"content":{"rendered":"<p>In the book <strong>Drafting Patents for Litigation and Licensing<\/strong> (published by BNA Books and the ABA section of Intellectual Property)\u00a0the authors caution that to avoid an argument that\u00a0a patent\u00a0specification has described\u00a0an invention narrowly, patent drafters should avoid making references to specific features or aspects of &#8220;the invention&#8221; or &#8220;the present invention.&#8221;\u00a0 Instead, all features, <span style=\"text-decoration: underline;\">aspects<\/span>, and characteristics should be described as being possible or potential or exemplary embodiments of the invention.<\/p>\n<p>In the recent\u00a0oral argument of <span style=\"text-decoration: underline;\">St. Clair Intellectual Property Consultants, Inc.\u00a0v.
