Biogen-Idec, et al.<\/span>, 2006-1634 (Fed. Cir. Dec. 19, 2008), she commented about applying a mental process exception so broadly under 35 U.S.C. \u00a7101 that it would lead down a slippery slope to\u00a0invalidate all software patents:\u00a0 [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2011\/04\/claussen-excerpt.mp3\">Listen<\/a>].\u00a0 <span style=\"text-decoration: underline;\">Classen<\/span> was decided prior to the Supreme Court&#8217;s opinion in <span style=\"text-decoration: underline;\">Bilski<\/span>.<\/p>\n<p>In <span style=\"text-decoration: underline;\">In re Rackman<\/span>, 2009-1217 (Fed. Cir. Nov. 4, 2009), she\u00a0pushed back on the PTO&#8217;s assertion that it was obvious to combine references if they merely enhanced functionality of the underlying reference, as to do so would arguably make every software invention obvious: [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2011\/04\/2009-1217-rackman-excerpt.mp3\">Listen<\/a>].<\/p>\n<p>You can\u00a0read the court&#8217;s opinions\u00a0in <span style=\"text-decoration: underline;\">Classen<\/span> and <span style=\"text-decoration: underline;\">Rackman<\/span> [<a href=\"http:\/\/www.cafc.uscourts.gov\/images\/stories\/opinions-orders\/06-1634.pdf\">here<\/a>] and [<a href=\"http:\/\/www.cafc.uscourts.gov\/images\/stories\/opinions-orders\/09-1217.pdf\">here<\/a>], respectively.<\/p>\n<p>You can\u00a0listen to the entire oral arguments in <span style=\"text-decoration: underline;\">Classen<\/span> and <span style=\"text-decoration: underline;\">Rackman<\/span> [<a href=\"http:\/\/oralarguments.cafc.uscourts.gov\/Audiomp3\/2006-1634.mp3\">here<\/a>] and [<a href=\"http:\/\/oralarguments.cafc.uscourts.gov\/Audiomp3\/2009-1217.mp3\">here<\/a>], respectively.<\/p>\n<p>She also made this comment in the <em>en banc<\/em>\u00a0oral argument\u00a0for <span style=\"text-decoration: underline;\">Tivo v.
