Becton, Dickinson and Co.<\/a>\u00a0is a good example of how oral arguments can foreshadow issues at the Federal Circuit.\u00a0 In this previous post &#8220;<a href=\"http:\/\/www.717madisonplace.com\/?p=2553\">Cybor Watch<\/a>&#8221;\u00a0, Judge Moore&#8217;s comments during oral argument foreshadowed\u00a0a possible desire to revisit the Federal Circuit&#8217;s <span style=\"text-decoration: underline;\">Cybor<\/span> decision.\u00a0 Yesterday&#8217;s dissents by Judge Moore (joined by Chief Judge Rader) and by Judge O&#8217;Malley articulated just such a desire to revisit <span style=\"text-decoration: underline;\">Cybor<\/span>.<\/p>\n<p>While the court can revisit the <span style=\"text-decoration: underline;\">Cybor<\/span> decision <em>sua sponte<\/em>, it will be interesting to see if litigants press the issue more aggressively\u00a0in the future &#8212; especially with two spots still to fill on the Federal Circuit&#8217;s roster of judges.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The denial of en banc review yesterday in Retractable Technologies, Inc. v.
