{"id":4573,"date":"2011-11-15T22:37:11","date_gmt":"2011-11-16T04:37:11","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=4573"},"modified":"2011-11-15T22:37:11","modified_gmt":"2011-11-16T04:37:11","slug":"judge-wallach-and-the-federal-circuit-residency-requirement","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=4573","title":{"rendered":"Judge Wallach and the Federal Circuit Residency Requirement"},"content":{"rendered":"<p>I was curious why no announcement has been made that Judge Evan Wallach, recently confirmed by the Senate, has been sworn in to office.\u00a0\u00a0The delay might be\u00a0the residency requirement for Federal Circuit judges.\u00a0<\/p>\n<p>As you are probably aware, the residency requirement was adopted with the creation of the Federal circuit and states in 28 U.S.C. 44(c) that:<\/p>\n<blockquote><p><a title=\"TITLE 28 - JUDICIARY AND JUDICIAL PROCEDURE\" href=\"http:\/\/www.717madisonplace.com\/wp-admin\/usc_sup_01_28.html\">TITLE 28<\/a> &gt; <a title=\"PART I - ORGANIZATION OF COURTS\" href=\"http:\/\/www.717madisonplace.com\/wp-admin\/usc_sup_01_28_10_I.html\">PART I<\/a> &gt; <a title=\"CHAPTER 3 - COURTS OF APPEALS\" href=\"http:\/\/www.717madisonplace.com\/wp-admin\/usc_sup_01_28_10_I_20_3.html\">CHAPTER 3<\/a> &gt; \u00a7 44<\/p>\n<div class=\"localinfo\">\n<h2 class=\"catchline\">\u00a7 44. Appointment, tenure, residence and salary of circuit judges<\/h2>\n<\/div>\n<div class=\"statute\">\n<div class=\"psection-1\"><a name=\"a\"><\/a><span class=\"enumbell\">(a)<\/span><span class=\"ptext-1\">The President shall appoint, by and with the advice and consent of the Senate, circuit judges for the several circuits as follows:<\/span><\/div>\n<table border=\"0\">\n<caption><\/caption>\n<tbody>\n<tr>\n<th>Circuits<\/th>\n<th>Number of Judges<\/th>\n<\/tr>\n<tr>\n<td>\u00a0<\/td>\n<\/tr>\n<tr>\n<td>District of Columbia<\/td>\n<td>11<\/td>\n<\/tr>\n<tr>\n<td>First<\/td>\n<td>6<\/td>\n<\/tr>\n<tr>\n<td>Second<\/td>\n<td>13<\/td>\n<\/tr>\n<tr>\n<td>Third<\/td>\n<td>14<\/td>\n<\/tr>\n<tr>\n<td>Fourth<\/td>\n<td>15<\/td>\n<\/tr>\n<tr>\n<td>Fifth<\/td>\n<td>17<\/td>\n<\/tr>\n<tr>\n<td>Sixth<\/td>\n<td>16<\/td>\n<\/tr>\n<tr>\n<td>Seventh<\/td>\n<td>11<\/td>\n<\/tr>\n<tr>\n<td>Eighth<\/td>\n<td>11<\/td>\n<\/tr>\n<tr>\n<td>Ninth<\/td>\n<td>29<\/td>\n<\/tr>\n<tr>\n<td>Tenth<\/td>\n<td>12<\/td>\n<\/tr>\n<tr>\n<td>Eleventh<\/td>\n<td>12<\/td>\n<\/tr>\n<tr>\n<td>Federal<\/td>\n<td>12.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>\u00a0<\/p>\n<div class=\"psection-1\"><a name=\"b\"><\/a><span class=\"enumbell\">(b)<\/span><span class=\"ptext-1\">Circuit judges shall hold office during good behavior.<\/span><\/div>\n<div class=\"psection-1\">\u00a0<\/div>\n<div class=\"psection-1\"><a name=\"c\"><\/a><span class=\"enumbell\">(c)<\/span><span class=\"ptext-1\">Except in the District of Columbia, each circuit judge shall be a resident of the circuit for which appointed at the time of his appointment and thereafter while in active service. While in active service, each circuit judge of the Federal judicial circuit appointed after the effective date of the Federal Courts Improvement Act of 1982, and the chief judge of the Federal judicial circuit, whenever appointed, shall reside within fifty miles of the District of Columbia. In each circuit (other than the Federal judicial circuit) there shall be at least one circuit judge in regular active service appointed from the residents of each state <a class=\"footref\" name=\"FN-1REF\" href=\"http:\/\/www.717madisonplace.com\/wp-admin\/#FN-1\"><sup>[1]<\/sup><\/a> in that circuit.<\/span><\/div>\n<div class=\"psection-1\"><a name=\"d\"><\/a>\u00a0<\/div>\n<div class=\"psection-1\"><span class=\"enumbell\">(d)<\/span><span class=\"ptext-1\">Each circuit judge shall receive a salary at an annual rate determined under section 225 of the Federal Salary Act of 1967 (<a href=\"http:\/\/www.law.cornell.edu\/uscode\/html\/uscode02\/usc_sup_01_2.html\">2<\/a> U.S.C. 351\u2013361), as adjusted by section <a href=\"http:\/\/www.law.cornell.edu\/uscode\/html\/uscode28\/usc_sec_28_00000461----000-.html\">461<\/a> of this title.<\/span><\/div>\n<\/div>\n<\/blockquote>\n<p>As far as I can tell, the America Invents Act did not ultimately\u00a0repeal this provision. So, according to the statute, Judge Wallach needs to establish residency within fifty miles of Washington, D.C. before he can become an active judge of the Federal Circuit.<\/p>\n<p>Judge Wallach noted the following in response to the Senate Judiciary Questionnaire:<\/p>\n<blockquote>\n<p class=\"MsoNormal\" style=\"line-height: normal; margin: 0in 0in 0pt; mso-layout-grid-align: none;\"><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\"><span style=\"font-size: small;\">3. <\/span><\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">Address: List current office address. <\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\"><span style=\"font-size: small;\">If <\/span><\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">city and state <\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\"><span style=\"font-size: small;\">of <\/span><\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">residence differs from your<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; margin: 0in 0in 0pt; mso-layout-grid-align: none;\"><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">place of employment, please list the <\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\"><span style=\"font-size: small;\">city <\/span><\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">and state where you currently reside.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; margin: 0in 0in 0pt; mso-layout-grid-align: none;\"><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; margin: 0in 0in 0pt; mso-layout-grid-align: none;\"><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">United States Court of lnternational Trade<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; margin: 0in 0in 0pt; mso-layout-grid-align: none;\"><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">One Federal Plaza<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 11.5pt;\">New York, New York 10278<\/span><\/p>\n<\/blockquote>\n<p>\u00a0So, presumably his former residence was New York and he needs to meet the necessary requirements to establish residency within fifty miles of Washington, D.C. before he can be sworn-in.\u00a0 What the necessary requirements are for establishing residency within 50 miles of Washington, D.C, I have no idea.\u00a0 But, if the rules for establishing in-state tuition for Maryland apply, for example, he might be in for a wait as long as six months.\u00a0 If that is the case, perhaps it will be a good excuse to spur Congress into action to finally revise 28 U.S.C. 44(c).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I was curious why no announcement has been made that Judge Evan Wallach, recently confirmed by the Senate, has been sworn in to office.\u00a0\u00a0The delay might be\u00a0the residency requirement for Federal Circuit judges.\u00a0 As you are probably aware, the residency requirement was adopted with the creation of the Federal circuit and states in 28 U.S.C.
