{"id":4877,"date":"2012-03-13T18:18:02","date_gmt":"2012-03-14T00:18:02","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=4877"},"modified":"2012-03-13T18:18:02","modified_gmt":"2012-03-14T00:18:02","slug":"oral-argument-on-tribal-land","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=4877","title":{"rendered":"Oral Argument on Tribal Land?"},"content":{"rendered":"<p>\u00a0<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2012\/03\/swcoloradofall2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-4972\" title=\"swcoloradofall2\" src=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2012\/03\/swcoloradofall2.jpg\" alt=\"swcoloradofall2\" width=\"440\" height=\"220\" srcset=\"https:\/\/www.717madisonplace.com\/wp-content\/uploads\/2012\/03\/swcoloradofall2.jpg 440w, https:\/\/www.717madisonplace.com\/wp-content\/uploads\/2012\/03\/swcoloradofall2-300x150.jpg 300w\" sizes=\"(max-width: 440px) 100vw, 440px\" \/><\/a><\/p>\n<p>The Federal Circuit will be coming to Colorado this fall to hear oral arguments as part of its mandate to periodically sit somewhere outside of Washington, D.C.\u00a0 A\u00a0small\u00a0percentage of the cases on the Federal Circuit&#8217;s docket each year\u00a0are cases concerning federal claims by indian tribes.\u00a0 I&#8217;m intrigued with the idea that\u00a0the Federal Circuit could conduct one of its sessions on tribal land.\u00a0 After 30 years of visiting constituencies in\u00a0various states, it seems justifiable that at least one session of the court\u00a0be held on tribal land.\u00a0 I&#8217;m not sure what kind of a turnout that session would get; but, I think it would be an historical opportunity for the court.\u00a0 (I don&#8217;t know whether\u00a0any other\u00a0federal court of appeals has ever heard oral argument on indian lands.)\u00a0 My understanding is that tribal lands\u00a0are held in trust by the U.S. government on behalf of the respective indian tribes.<\/p>\n<p>The Federal Circuit Bar Association&#8217;s website has a committee focused on Federal Indian Law.\u00a0 The blurb on their page states:<\/p>\n<blockquote><p><span class=\"h1\">Federal Indian Law is an important component in the origin, history and specific jurisdiction of the U.S. Court of Appeals for the Federal Circuit, and remains an important practice area in the Court, today. The U.S. Court of Appeals for the Federal Circuit has helped shape Federal Indian Law in many landmark or significant cases. In addition, the year 2006 marks the 60th year anniversary of the establishment of the Indian Claims Commission which, 30 years later, was abolished. Many remaining cases devolved to the docket of the United States Court of Federal Claims and were reviewed by the Federal Circuit. Among its goals, this Committee seeks collaboration with the Federal Circuit Historical Society, as well as other interested Committees, in examining the impact of the Indian Claims Commission and its ultimate assimilation into the Court of Claims. The opportunity to develop a special edition of the Federal Circuit Bar Journal on this topic is also a possibility as part of the activity surrounding this anniversary<\/span><span style=\"FONT-FAMILY: Arial; FONT-SIZE: 10pt\"><span style=\"color: #000000;\">.<\/span><\/span><\/p><\/blockquote>\n<p>One good venue for holding oral arguments\u00a0would be the Southern Ute Indian Reservation down in the southwestern part of the state where Colorado, New Mexico, Arizona, and\u00a0Utah border one another.\u00a0 As you can see from the map below, that site is proximate a large area of different tribal lands (e.g., Ute Mountain Tribe, Southern Ute Tribe, Navajo Nation, and\u00a0Jicarilla Apache).\u00a0 And, it is recognized for having a nice facility for holding oral argument.
