{"id":5210,"date":"2012-05-31T18:04:25","date_gmt":"2012-06-01T00:04:25","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=5210"},"modified":"2012-05-31T18:04:25","modified_gmt":"2012-06-01T00:04:25","slug":"reading-tea-leaves","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=5210","title":{"rendered":"Reading Tea Leaves"},"content":{"rendered":"<p>Listening to oral argument recordings from various cases presents an opportunity to try and read the tea leaves as to where the Federal Circuit is heading with respect to a particular area of the law.\u00a0 The oral argument in <span style=\"text-decoration: underline;\">Walker Digital v. Microsoft<\/span>, 2011-1419 (Fed. Cir. 2012) presents one such opportunity.\u00a0<\/p>\n<p>In the oral argument of <span style=\"text-decoration: underline;\">Walker Digital v. Microsoft<\/span>, which was argued on March 9, 2012, Judge Moore made a comment about the patentee having a problem if the claims were construed in such a way that they required joint infringement.\u00a0 The <span style=\"text-decoration: underline;\">Akamai v. Limelight<\/span> and <span style=\"text-decoration: underline;\">McKesson v. Epic<\/span> cases were argued <em>en banc<\/em>\u00a0four months earlier &#8212; so, presumably, Judge Moore knew as of March 9, 2012 which way the CAFC was headed in deciding\u00a0those cases when she made her comment.\u00a0 You can listen to the sound bite yourself and see if you think it indicates how the CAFC will decide those <em>en banc<\/em> divided infringement cases: [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2012\/05\/2011-1419-excerpt-1.mp3\">Listen<\/a>].<\/p>\n<p>As a sidenote, Judge Moore also took a friendly shot at patent prosecutors and their alleged deficiencies when it comes to knowing the rules of grammar:\u00a0 [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2012\/05\/2011-1419-excerpt-2.mp3\">Listen<\/a>].\u00a0 Ouch.\u00a0 Of course, a patent prosecutor is entitled to be\u00a0his or her\u00a0own grammarian.\u00a0 <span style=\"text-decoration: underline;\">See<\/span> <span style=\"text-decoration: underline;\">Chicago Steel Foundry Co. v.
