USPTO et al.<\/span> case decided this past week (aka <span style=\"text-decoration: underline;\">Myriad II<\/span>) puts a new twist on the dreaded words &#8220;We&#8217;re from the government and we&#8217;re here to help you.&#8221; \u00a0In <span style=\"text-decoration: underline;\">Myriad II<\/span> it was the USPTO that was afflicted by the words &#8220;We&#8217;re from the <span style=\"text-decoration: line-through;\">Government<\/span> <span style=\"text-decoration: underline;\">Solicitor General&#8217;s Office<\/span> and We&#8217;re Here to Help You.&#8221;<\/p>\n<p>The <span style=\"text-decoration: underline;\">Myriad<\/span> case is unique in that the US Solicitor General&#8217;s Office pulled rank on the USPTO Solicitor&#8217;s Office for purposes of briefing and oral argument.\u00a0\u00a0In the first oral argument of <span style=\"text-decoration: underline;\">Myriad<\/span> at the Federal Circuit (<span style=\"text-decoration: underline;\">Myriad I<\/span>), the SG&#8217;s Office brought unintended comic relief to the proceedings by proposing a &#8220;magic microscope&#8221; test.<\/p>\n<p>One of the first questions asked at the oral argument of <span style=\"text-decoration: underline;\">Myriad II<\/span> in July was whether the SG&#8217;s Office was still advocating such a test. \u00a0Unwilling to distance itself entirely from its &#8220;magic microscope,&#8221; \u00a0the SG&#8217;s Office stated that it still found the &#8220;magic microscope&#8221; to be a useful metaphor.<\/p>\n<p>One thing that interested me about the oral argument of <span style=\"text-decoration: underline;\">Myriad II<\/span> was Judge Bryson&#8217;s comment that in the past the US Attorney General&#8217;s Office has allowed an administrative agency to file, as an appendix to the SG&#8217;s brief, a brief that dissents \u00a0from the SG&#8217;s position. \u00a0Judge Bryson cited the <span style=\"text-decoration: underline;\">TVA v. Hill<\/span>, 437 U.S. 153 (1978) case as one example.
