The doctrine of claim vitiation has yielded some interesting comments from the bench in past cases. \u00a0See these posts for past comments by Chief Judge Rader. [<a href=\"http:\/\/www.717madisonplace.com\/?p=3457\">Link<\/a>], [<a href=\"http:\/\/www.717madisonplace.com\/?p=2030\">Link<\/a>], and \u00a0[<a href=\"http:\/\/www.717madisonplace.com\/?p=2039\">Link<\/a>].<\/p>\n<p>Judge Moore had some frank words about the doctrine of claim vitiation during the oral argument of <span style=\"text-decoration: underline;\">Source Vagabond Systems Ltd. v. Hydrapak, Inc.<\/span>, 2012-1408 (Fed. Cir. 2013)(Rule 36 Judgment): \u00a0[<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2013\/02\/2012-1408-excerpt-1.mp3\">Listen<\/a>] and [<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2013\/02\/2012-1408-excerpt-2.mp3\">Listen<\/a>]. \u00a0In the second sound bite, she notes that she would be happy to &#8220;scratch it out of existence.&#8221;<\/p>\n<p>You can listen to the entire oral argument from <span style=\"text-decoration: underline;\">Source Vagabond<\/span> here:  [<a href=\"http:\/\/oralarguments.cafc.uscourts.gov\/Audiomp3\/2012-1408.mp3\">Listen<\/a>].<\/p>\n<p>Personally, I find the doctrine of claim vitiation to be a useful tool when there clearly \u00a0is no equivalent. \u00a0However, I understand the court&#8217;s frustration with how to apply the doctrine.<\/p>\n<p>Here is one more post on the related issue of the specific exclusion principle: [<a href=\"http:\/\/www.717madisonplace.com\/?p=2846\">Link<\/a>].<\/p>\n<p>Two recently decided Federal Circuit cases that deal with claim vitiation are:<\/p>\n<p><span style=\"text-decoration: underline;\">Deere and Co. v.
