Patent attorneys often express frustration over various\u00a0holdings of the Federal Circuit.\u00a0 This has certainly been true of\u00a0decisions of the court in the area of damages and reasonable royalties.\u00a0 It was interesting to hear Chief Judge Michel’s own frustration with some of the court’s holdings in the recent oral argument of Lucent Technologies v. Gateway<\/span>.\u00a0 You can\u00a0listen to\u00a0Chief Judge Michel’s comments [Here<\/a>] and [Here<\/a>].\u00a0<\/p>\n

There was a lighter moment in the oral argument when Chief Judge Michel asked counsel for\u00a0Lucent \u00a0if the court should grant judgment in favor of Lucent if the panel deemed that Lucent’s expert\u00a0had provided sufficient\u00a0testimony on damages\u00a0 — counsel\u00a0for Lucent agreed that would be proper.\u00a0\u00a0However, when Chief Judge Michel asked counsel for\u00a0Lucent \u00a0if the court should grant judgment in favor of Microsoft if the panel deemed that\u00a0Lucent’s expert\u00a0had not<\/span> provided sufficient\u00a0testimony on damages, counsel for Lucent offered that perhaps a remand to the district court might be another choice.\u00a0\u00a0 [Listen<\/a>]<\/p>\n

The panel extended the oral argument to 70 minutes for this case — more than double the normal 30 minutes — and was quite complimentary of the\u00a0argument conducted\u00a0by Constantine Trela on behalf of Microsoft and John Desmarais on behalf of Lucent [Listen<\/a>].<\/p>\n
