{"id":6512,"date":"2014-02-19T19:42:24","date_gmt":"2014-02-20T01:42:24","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=6512"},"modified":"2014-02-25T00:31:35","modified_gmt":"2014-02-25T06:31:35","slug":"what-will-be-the-next-en-banc-issue","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=6512","title":{"rendered":"What will be the next en banc issue?"},"content":{"rendered":"<p>It has been quite some time since the Federal Circuit accepted a new case for <em>en banc<\/em> review. \u00a0The court is currently reviewing <em>en banc<\/em> the <em>Lighting Ballast Control v. Phillips Electronics<\/em><em> <\/em>case in order to reconsider<em> <\/em><em>Cybor Corp. v. FAS Techs., Inc<\/em><span>., 138 F.3d 1448 (Fed. Cir. 1998) (en banc). \u00a0But, what will be the next case? \u00a0Has the court already taken a case <em>en banc sua sponte sub <\/em><em>secretum* <\/em>without further briefing? <\/span><\/p>\n<p><span>There are several topics ripe for review.<\/span><\/p>\n<p><span>1) \u00a0Functional language is the hot topic these days. \u00a0I would not be surprised to see the court take on &#8220;functional language&#8221; in some manner.<\/span><\/p>\n<p>2) \u00a0<em>FInjan<\/em>. \u00a0The court had to tap dance around the <em>Finjan<\/em> decision in a recent appeal. \u00a0I would not mind seeing that issue addressed <em>en banc<\/em>. \u00a0See this prior post [<a href=\"http:\/\/www.717madisonplace.com\/?p=3548\">Link<\/a>].<\/p>\n<p>3) \u00a0The <em>In re Abele\/Cybersource v. Retail Solutions\/Smartgene v. Advanced Biological Industries<\/em> <span style=\"text-decoration: line-through;\">tragedy<\/span> trilogy of cases.<\/p>\n<p>4) \u00a0<em>Atmel<\/em>. \u00a0In yesterday&#8217;s opinion in <em>Otto Bock Healthcare v. Ossur<\/em>, Judge Lourie clarified his opinion for the court in\u00a0<span><em>Atmel Corp. v. Info Storage<\/em><\/span><\/p>\n<p><span><em>Devices<\/em>, 198 F.3d 1374 (Fed. Cir. 1999) by stating:<\/span><\/p>\n<blockquote><p>Further, Otto Bock\u2019s reliance on <em>Atmel<\/em> is misplaced.<\/p>\n<p><em>Atmel<\/em> only foreclosed the use of the content of a nonpatent<\/p>\n<p>publication incorporated by reference to add structure<\/p>\n<p>to a means-plus-function claim. <em>Atmel<\/em>, 198 F.3d at<\/p>\n<p>1382. <em>Atmel<\/em> did not purport to include U.S. patent applications.<\/p>\n<p>In fact, 37 C.F.R. 1.57(d) specifically envisions<\/p>\n<p>using a U.S. patent application incorporated by reference<\/p>\n<p>to define structure for the purpose of 35 U.S.C. \u00a7 112, \u00b6 6.<\/p>\n<p>The court thus did not err in using the \u2019274 application\u2019s<\/p>\n<p>incorporation by reference to construe the term \u201cmeans<\/p>\n<p>for maintaining a vacuum\u201d to mean a \u201cweight-actuated<\/p>\n<p>vacuum pump as disclosed in [the \u2019274 application].\u201d<\/p><\/blockquote>\n<p>Irah Donner writes in his excellent book <em>Patent Prosecution<\/em>:<\/p>\n<blockquote><p>The <em>Atmel Corp.<\/em> decision is troublesome with respect to its reluctance to utilize the incorporation-by-reference rule to recite corresponding structure, particularly since this rule has been around for many years, including prior to the enactment of Section 112, sixth paragraph. . . . Hopefully, the Federal Circuit will have the opportunity to reconsider this issue in the future.<\/p>\n<p><em>See<\/em> <em>Patent Prosecution<\/em>, Fifth Edition,2007, at pages 2211-12.<\/p><\/blockquote>\n<p>I don&#8217;t really have a dog in the fight with respect to <em>Atmel<\/em><em>.<\/em> I am not particularly fond of means-plus-function claims. \u00a0I suspect, however, that means-plus-function and step-plus-function claiming will take on a greater role in the future to combat \u00a7112 (lack of enablement due to overbreadth) and \u00a7101 invalidity assertions. \u00a0Namely, it seems harder to argue that a step-plus-function claim is overly broad, preempts all applications, or is abstract, if it is limited to the acts disclosed in the specification. \u00a0I also find means-plus-function claims a pain in the neck to deal with whenever I write an invalidity or non-infringement opinion &#8212; so, they have value in that regard, as well. \u00a0And, there have been a number of cases with large damages awards that are based on mean-plus-function claims.<\/p>\n<p>Now that I have sufficiently jinxed these issues, we&#8217;ll see when and what issue the <em>en banc<\/em> court takes on next.<\/p>\n<p>*By the way, I stole the phrase &#8220;<em>sua sponte sub secretum<\/em>&#8221; from Dennis Crouch.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>It has been quite some time since the Federal Circuit accepted a new case for en banc review. \u00a0The court is currently reviewing en banc the Lighting Ballast Control v.
