Pacsgear<\/span> will interest some practitioners. \u00a0The issues on appeal were how the words &#8220;data&#8221; and &#8220;automatically&#8221; should be construed.<\/p>\n<p>I always find it interesting when somebody coins a new term. \u00a0For example, in\u00a0<em>Omega Engineering, Inc v. Raytek Corp.<\/em><span>, 334 F.3d 1314 (Fed. Cir. 2003) the phrase &#8220;prosecution disclaimer&#8221; was added to our lexicon. \u00a0In 2004, Lemley et al. introduced the phrase &#8220;divided infringement.&#8221; \u00a0In the <span style=\"text-decoration: underline;\">Datcard Systems v. Pacsgear<\/span> oral argument, Judge Chen notes that the cases of \u00a0<span style=\"text-decoration: underline;\">Edwards Life Sciences v. Cook<\/span> and <span style=\"text-decoration: underline;\">Bid for Position v.
