Stamps.com<\/span>, the panel reviewing the\u00a0district court\u00a0judgment\u00a0was faced with reviewing a district court judge&#8217;s claim construction.\u00a0 During the\u00a0district court&#8217;s claim construction hearing,\u00a0evidence from dueling expert witnesses was offered.\u00a0 Judge Moore noted that the\u00a0outcome of the review of the district court&#8217;s\u00a0claim construction\u00a0might differ depending on whether the panel reviewed the\u00a0claim construction\u00a0(1)\u00a0de novo or (2) with deference to the district court judge&#8217;s evaluation of the expert evidence.\u00a0 Judge Moore inquired of counsel\u00a0for the defendant-appellee whether the court should revisit its <em>en banc<\/em> decision in <span style=\"text-decoration: underline;\">Cybor v. FAS Technologies, Inc.<\/span>\u00a0\u00a0\u00a0\u00a0[<a href=\"http:\/\/www.717madisonplace.com\/wp-content\/uploads\/2009\/09\/2009-1027-excerpt-1.mp3\">Listen<\/a>]\u00a0 In <span style=\"text-decoration: underline;\">Cybor<\/span>, the Federal Circuit held that the court reviewed claim construction de novo including underlying issues of fact.<\/p>\n<p>You may recall Judge Mayer&#8217;s dissent in the <span style=\"text-decoration: underline;\">Phillips v. AWH Corp.<\/span> case in which he commented:<\/p>\n<blockquote>\n<p class=\"indent\">Until the court is willing to reconsider its holdings in <em>Markman v. Westview Instruments, Inc.,<\/em> <a href=\"http:\/\/www.717madisonplace.com\/52\/f3d\/967\">52 F.3d 967<\/a> (Fed.Cir.1995) (en banc), <em>aff&#8217;d on other grounds,<\/em> <a href=\"http:\/\/www.717madisonplace.com\/517\/us\/370\">517 U.S. 370<\/a>, 116 S.Ct. 1384, 134 L.Ed.2d 577 (1996), and <em>Cybor Corp. v. FAS Techs., Inc.,<\/em> <a href=\"http:\/\/www.717madisonplace.com\/138\/f3d\/1448\">138 F.3d 1448<\/a> (Fed.Cir.1998) (en banc), that claim construction is a pure question of law subject to <em>de novo<\/em> review in this court, any attempt to refine the process is futile. Nearly a decade of confusion has resulted from the fiction that claim construction is a matter of law, when it is obvious that it depends on underlying factual determinations which, like all factual questions if disputed, are the province of the trial court, reviewable on appeal for clear error. To pretend otherwise inspires cynicism.
