{"id":7379,"date":"2015-06-16T18:29:49","date_gmt":"2015-06-17T00:29:49","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=7379"},"modified":"2015-06-16T18:54:48","modified_gmt":"2015-06-17T00:54:48","slug":"avoiding-recusal","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=7379","title":{"rendered":"Avoiding Recusal?"},"content":{"rendered":"<p>Whenever there is a rash of Rule 36 decisions, it seems as though an unanticipated\u00a0<em>en\u00a0banc<\/em> decision is soon to follow. \u00a0Lately, the Federal Circuit has issued what seems like a large number of Rule 36 decisions &#8212; and, sure enough, today it issued an<em> en banc<\/em> decision in <em>Williamson v. Citrix<\/em>.<\/p>\n<p>The cynic in me wonders if the reason that the court takes some cases <em>en banc<\/em> without\u00a0oral argument is to avoid the opportunity for further <em>amicus <\/em>briefing that could cause recusal of some of its members. \u00a0Both judges O&#8217;Malley and Moore are at risk of being gamed out of <em>en banc<\/em> decisions when their respective husbands&#8217; firms are enlisted to submit <em>amicus<\/em> briefs. \u00a0Once judicial candidate Stoll is confirmed by the Senate, a third judge will be at risk of recusal during <em>en banc<\/em> cases due to at least one close relative practicing in the patent field.<\/p>\n<p>Perhaps the Federal Circuit should consider an internal rule to address this issue.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Whenever there is a rash of Rule 36 decisions, it seems as though an unanticipated\u00a0en\u00a0banc decision is soon to follow. \u00a0Lately, the Federal Circuit has issued what seems like a large number of Rule 36 decisions &#8212; and, sure enough, today it issued an en banc decision in Williamson v.
