Ed. 2d 131 (2011)<\/span> the Supreme Court of the United States stated:<\/p>\n<div class=\"page\" title=\"Page 4\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote><p>Under \u00a7282 of the Patent Act of 1952, \u201c[a] patent shall be presumed valid\u201d and \u201c[t]he burden of establishing invalidity of a patent or any claim thereof shall rest on the party asserting such invalidity.\u201d 35 U. S. C. \u00a7282. We consider whether \u00a7282 requires an invalidity defense to be proved by clear and convincing <strong><em>evidence<\/em><\/strong>. We hold that it does.<\/p><\/blockquote>\n<p><em><em>Microsoft Corp. v. i4i Ltd. Partnership<\/em><\/em>, 131 S. Ct. 2238 (2011) (emphasis added).<\/p>\n<p>The issue of evidence with respect to 35 U.S.C. \u00a7101 takes center stage in the oral argument of \u00a0<em>CMG FINANCIAL SERVICES, INC. v. PACIFIC TRUST BANK, FSB<\/em><span>, No. 2014-1855 (Fed. Cir. Sept. 15, 2015). [<a href=\"http:\/\/oralarguments.cafc.uscourts.gov\/Audiomp3\/2014-1855.mp3\">Link<\/a>]<\/span><\/p>\n<p><span>As you can see from the Rule 36 Judgment <\/span>[l<a href=\"https:\/\/scholar.google.com\/scholar_case?case=18249050834429032543&amp;q=pacific+2015&amp;hl=en&amp;as_sdt=4,131\">ink<\/a>], the panel punted on the issue &#8212; which reminds me of another quote:<\/p>\n<blockquote><p><span>It is emphatically the province and duty of the judicial department to say what the law is. Those who apply the rule to particular cases, must of necessity expound and interpret that rule.<\/span><\/p><\/blockquote>\n<p><em>Marbury v.
