{"id":7593,"date":"2015-11-09T22:08:45","date_gmt":"2015-11-10T04:08:45","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=7593"},"modified":"2015-11-09T22:08:45","modified_gmt":"2015-11-10T04:08:45","slug":"uspto-still-relying-on-rule-36-judgments","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=7593","title":{"rendered":"USPTO Still Relying on Rule 36 Judgments"},"content":{"rendered":"<p>Last week, the USPTO updated its Appendix 3 of the Subject Matter Eligibility Court Decisions:<\/p>\n<ul>\n<li><a href=\"http:\/\/www.uspto.gov\/sites\/default\/files\/documents\/ieg-july-2015-app3.pdf\">July 2015 Update Appendix 3:\u00a0 Subject Matter Eligibility Court Decisions<\/a><strong><span>NEW<\/span><\/strong> [updated Nov. 4, 2015].<\/li>\n<\/ul>\n<p>It surprises me that the USPTO still includes some Rule 36 judgments as part of its chart (see the asterisked entries in the chart). \u00a0A Rule 36 affirmance by the Federal Circuit is merely a statement that a lower tribunal reached the correct result &#8212; but, it is not an endorsement of any reasoning of the lower tribunal, e.g., whether a proposed abstract idea is indeed an abstract idea. \u00a0In an opinion that he authored for the court, Judge Linn put it this way:<\/p>\n<blockquote><p><span>Similarly, our Rule 36 judgments only affirm the judgment of the lower tribunal. &#8220;[A] Rule 36 judgment simply confirms that the trial court entered the correct judgment. It does not endorse or reject any specific part of the trial court&#8217;s reasoning.&#8221; <\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=7309216387352426196&amp;q=Rates+Tech.,+Inc.+v.+Medi-+atrix+Telecom,+Inc.,+688+F.3d+742,+750+(Fed.+Cir.+2012).&amp;hl=en&amp;as_sdt=4006\"><em><strong>Rates <\/strong><strong>Tech<\/strong>.,\u00a0<strong>Inc<\/strong>. v. Mediatrix\u00a0<strong>Telecom<\/strong>,\u00a0<strong>Inc<\/strong>.,<\/em> <strong>688 <\/strong><strong>F.3d <\/strong><strong>742<\/strong>,\u00a0<strong>750<\/strong> (<strong>Fed<\/strong>.<strong>Cir<\/strong>.\u00a0<strong>2012<\/strong>)<\/a><span>.<\/span><\/p><\/blockquote>\n<p><em>TecSec v. International Business Machines Corp.<\/em><span>, 731 F.3d 1336, 1343 (Fed.
