Florida Bar"},"content":{"rendered":"<p>The Federal Circuit&#8217;s recent decision in\u00a0<a href=\"http:\/\/www.cafc.uscourts.gov\/sites\/default\/files\/opinions-orders\/15-145.Opinion.3-3-2016.1.PDF\">In re Queen&#8217;s University<\/a> deals with whether patent agent\/client communications are privileged. \u00a0The Federal Circuit leans heavily on the US Supreme Court case \u00a0<span style=\"text-decoration: underline;\">Sperry v. Florida ex real. Florida Bar<\/span> to find that there is such a privilege.<\/p>\n<p>The Oyez site has done a great job of making the oral arguments from the Supreme Court cases available for listening. \u00a0The playback of the oral arguments even shows a portrait of each justice when that particular justice speaks during playback. \u00a0At any rate, you can listen to the oral argument of the <span style=\"text-decoration: underline;\">Sperry<\/span> case via the Oyez site [<a href=\"https:\/\/www.oyez.org\/cases\/1962\/322\">here<\/a>].<\/p>\n<p>In footnote 2 of the dissent in <span style=\"text-decoration: underline;\">In re Queen&#8217;s University<\/span>, the dissent seems to dismiss the importance of the issue since no amicus briefs were filed in the case. \u00a0For what it&#8217;s worth, I consider myself pretty well apprised of what is going on in the patent world and I was not aware of the case until it was recently decided. \u00a0Moreover, the Office of Enrollment and Discipline shows that patent agents account for roughly 1\/4 of all practitioners registered to practice before the USPTO:<\/p>\n<blockquote><p>&#8220;<span>Currently, there are 11045 active agents and 33133 active attorneys.<\/span>&#8220;<\/p><\/blockquote>\n<p>See\u00a0https:\/\/oedci.uspto.gov\/OEDCI\/practitionerhome.jsp (last visited on 3\/15\/2016).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Federal Circuit&#8217;s recent decision in\u00a0In re Queen&#8217;s University deals with whether patent agent\/client communications are privileged. \u00a0The Federal Circuit leans heavily on the US Supreme Court case \u00a0Sperry v.
