{"id":7882,"date":"2016-05-06T09:44:44","date_gmt":"2016-05-06T15:44:44","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=7882"},"modified":"2016-05-06T11:46:10","modified_gmt":"2016-05-06T17:46:10","slug":"rule-36-opinions-still-being-relied-upon","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=7882","title":{"rendered":"Rule 36 Opinions Still Being Relied Upon"},"content":{"rendered":"<p>It is interesting that in the May 2016 Subject Matter Eligibility Guidance, the USPTO continues to rely upon Rule 36 opinions as being instructive. \u00a0The Federal Circuit does not always address all issues on appeal to reach an affirmance of the Board. \u00a0For example, in <span style=\"text-decoration: underline;\">In re Gleave<\/span> the court stated:<\/p>\n<blockquote><p><span>Therefore, we affirm the Board&#8217;s rejection of claims 1, 4, 15, and 18-21 of the &#8216;493 application under \u00a7 102(b). We need not reach the \u00a7 103 obviousness rejection.<\/span><\/p><\/blockquote>\n<div id=\"gs_reference_w\">\n<div id=\"gs_reference\" class=\" gs_vis\"><span style=\"text-decoration: underline;\">In re Gleave<\/span>, 560 F. 3d 1331, 1338 (Fed. Cir. 2009)<\/div>\n<\/div>\n<div id=\"gs_leaf_bdy\"><\/div>\n<p>To the extent that an appeal resolved by a Rule 36 opinion contained more than a \u00a7101 rejection, how can the USPTO be certain that the Federal Circuit was affirming the rationale of the \u00a7101 rejection rather than just a \u00a7103 rejection, for example?<\/p>\n<p>Moreover, I&#8217;m reminded of Judge Moore&#8217;s comment in \u00a0the\u00a0<span>oral argument of <\/span><span><span style=\"text-decoration: underline;\">In re Collins<\/span><\/span><span>, App. No. 2011-1293 (Fed. Cir. 2012). Judges Moore and Reyna took the PTO to task for a sloppy rejection of a claim.\u00a0\u00a0 An exasperated Judge Moore would remark \u201c<\/span><em>I think this is a terrible rejection.\u00a0 I think you all [USPTO]\u00a0have done a really sloppy job.\u00a0 . . .
