DOJ<\/em>, the Federal Circuit will consider the following issue:<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote><p><span>Whether a preference eligible employee of the Federal Bureau of Investigation challenging an adverse employment action before the Merit Systems Protection Board under 5 U.S.C. \u00a7 7513(d) may raise whistleblower reprisal in violation of 5 U.S.C. \u00a7 2303 as an affirmative defense under 5 U.S.C. \u00a7 7701(c)(2)(C). <\/span><\/p><\/blockquote>\n<\/div>\n<\/div>\n<\/div>\n<p>The date for oral argument in <em>WI-FI ONE, LLC v. BROADCOM CORPORATION<\/em> has not yet been set. \u00a0The Federal Circuit has phrased the issue in that en banc case as:<\/p>\n<blockquote><p>Should this court overrule <em>Achates Reference Publishing, Inc. v. Apple Inc.<\/em>, 803 F.3d 652 (Fed.
