{"id":8798,"date":"2017-03-24T10:21:45","date_gmt":"2017-03-24T16:21:45","guid":{"rendered":"http:\/\/www.717madisonplace.com\/?p=8798"},"modified":"2017-05-21T11:15:43","modified_gmt":"2017-05-21T17:15:43","slug":"patents-as-property-rights-mining-patents-that-is","status":"publish","type":"post","link":"https:\/\/www.717madisonplace.com\/?p=8798","title":{"rendered":"Patents as property rights &#8212; mining patents, that is"},"content":{"rendered":"<p>________________________________________________________________<\/p>\n<p><strong>Update: May 21, 2017<\/strong><\/p>\n<p>The Federal Circuit issued an errata with respect to the <em>Reoforce<\/em> opinion on April 28, 2017. \u00a0The errata significantly changes the language of the decision in some respects: \u00a0[<a href=\"http:\/\/www.cafc.uscourts.gov\/sites\/default\/files\/opinions-orders\/15-5084.Errata.4-27-2017.1.PDF\">Link<\/a>]. \u00a0For example, the correction now states that an unpatented mining claim is a property right in the full sense:<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote><p><span>The Mining Law allows the holder of a valid mining claim to apply for \u201ca \u2018patent,\u2019 that is, an official document issued by the United States attesting that fee title to the land is in the private owner.\u201d <\/span><span>Kunkes v. United States<\/span><span>, 78 F.3d 1549, 1551 (Fed. Cir. 1996). <\/span><span>[in- sert footnote 1] <\/span><span>Until a patent issues, however, the mining claimant has an \u201cunpatented\u201d mining claim, a \u201cunique form of property.\u201d <\/span><span>Best<\/span><span>, 371 U.S. at 335\u2013 36; <\/span><span>see also Union Oil Co. v. Smith<\/span><span>, 249 U.S. 337, 349 (1919) (an unpatented mining claim is \u201ca property right in the full sense\u201d).<\/span><\/p><\/blockquote>\n<\/div>\n<\/div>\n<\/div>\n<p>________________________________________________________________<\/p>\n<p>The Federal Circuit issued a different kind of patent opinion last week &#8212; a decision relating to patents on mining claims. \u00a0Apparently, the patents that the US government issues for mining claims are considered property rights in the full sense:<\/p>\n<blockquote><p><span>Once established, a mining claimant receives &#8220;a `patent,&#8217; that is, an official document issued by the United States attesting that fee title to the land is in the private owner.&#8221; <\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=12506550298304805092&amp;q=patent+and+%22federal+claims%22&amp;hl=en&amp;as_sdt=4,131&amp;scilh=0\"><em>Kunkes v. United States,<\/em> 78 F.3d 1549, 1551 (Fed. Cir. 1996)<\/a><span>. A patented mining claim is &#8220;a property right in the full sense.&#8221; <\/span><a href=\"https:\/\/scholar.google.com\/scholar_case?case=17372751569552139919&amp;q=patent+and+%22federal+claims%22&amp;hl=en&amp;as_sdt=4,131&amp;scilh=0\"><em>Union Oil Co. v.
