KISE: Well, Mr. Chief Justice,<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">12 \u00a0 the panel packing, if you will, mentioned by<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">13 \u00a0 Petitioner in the briefs, I don&#8217;t believe -\u00ad<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">14 \u00a0 and &#8212; and I&#8217;ll leave it to the government to<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">15 \u00a0 &#8212; to have the exact statistics &#8212; precise<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">16 \u00a0 statistics, but I don&#8217;t believe that&#8217;s taken<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">17 \u00a0 place more than one or two times, and I don&#8217;t<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">18 \u00a0 believe it&#8217;s taken place with respect -\u00ad<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">19 \u00a0 JUSTICE KENNEDY: Well, suppose it<\/span><\/p>\n<p><span style=\"font-family: Consolas, Monaco, monospace;\">20 \u00a0 were rampant.<\/span><\/p><\/blockquote>\n<p>I suppose rampant is a subjective term; but, in the oral argument of <em>Nidec v. And, the Chief Judge actually makes that decision.And, the judges are selected based on their technical and legal competency. And, over the years, many many panels at the Board have been expanded. In fact if you looked at the thirty . . . .<\/p>\n<p>Judge Reyna: Are they selected on whether they\u2019re going to rule in a certain way?<\/p>\n<p>PTO: Uh, well, people can be placed on the panel . . . for example, the Director can place him or herself on the panel, and certainly the Director knows how they\u2019re going to rule. Nidec has not said and they say at their blue brief at page 43 that they don\u2019t challenge the independence of these judges on this panel. Um, these judges were not selected and told to make a particular decision.
